According to a body of the Ministry of Justice, the operator misled consumers and violated the Consumer Protection CodeThe Senacon (National Consumer Secretariat), linked to the Ministry of Justice and Public Security.
The punishment was applied by the director of DPDC (Department of Consumer Protection and Defense), Vitor Hugo do Amaral Ferreira, as published in the Official Gazette of the Union on this Monday (May 20, 2024). Here is the full document (PDF – 75 kB).
According to the document, the penalty was given due to a “failure in providing correct, clear, precise, and conspicuous information, deceptive advertising, advertising messages related to 5G,” which would have misled consumers and breached the Consumer Protection Code.
The Claro stated to Poder360 that it does not comment on administrative decisions, but will appeal.
