Those who fail to comply with these rules are subject to fines, as well as even more severe penalties, such as the suspension of their CNPJ.

What is the fine amount for the MEI that violates the new government rule? Find out the details(Photo: FDR)By complying with their obligations as an MEI, the entrepreneur gains access to all the benefits of opening their company.

This includes the unified payment of taxes, through the DAS (Single National Tax Payment Document), reducing the monthly costs of maintaining a business. In addition to having an active CNPJ, which ensures the issuance of tax invoices and the possibility of selling or providing services to other companies or public entities.

It is also seen as an advantage that the entrepreneur starts contributing to social security in their own name. That said, keeping your obligations up to date guarantees the success of your small business.

Apart from the mandatory tax payments, the MEI also needs to be attentive to the declarations to maintain the company’s regularity.

One of these declarations is the registration in the Electronic Labor Domicile (DET), those who miss the deadline and do not make their registration as necessary are subject to a fine ranging from R$ 208.09 to R$ 2,080.91.What is the DET?

The DET is a new digital platform from the Ministry of Labor and Employment, created with the aim of enabling electronic communication between the employer, that is, whoever has an employee, and the Labor Inspection.

The idea is that through the digitization of services, employers can stay informed about any administrative acts, tax actions, summonses, and general notifications. In general terms, the DET functions as a form in which the MEI informs the government of their contact details.

From this point on, all the necessary information about Labor Inspection will be received at the registered email address.“

Provide and keep updated at least one electronic postal address (e-mail), in order to enable the receipt of alerts upon the arrival of a new message in your Mailbox in the DET”, explained labor auditor Bruno Carlo Wanderley, as reported by EXTRA.

Which companies need to register with DET?According to the rules already disclosed by the Ministry of Labor and Employment, registration in the DET is voluntary, at least initially.

Those who do not inform their contact details by the extended deadline will not have to deal with consequences.Fines and penalties will be applied from the sending of notifications via DET, without a response from the employer, which will be explained in more detail shortly in this article.

The portal was created for communication between the Brazilian government and:Medium and large companies;MEI;Domestic employers.

According to Sebrae (Brazilian Support Service for Micro and Small Enterprises), even the MEI without employees must fill in the contact details in the DET.

Fines for the MEI that does not update their registryIn reality, if the employer does not register an email for receiving alerts and does not access DET, the knowledge of electronic communications will be presumed.

Therefore, there is no fine for the MEI that does not update their registration through the portal. What actually happens is that if the employer is notified by a tax auditor and does not respond to the notification, they may be fined and penalized.

The amounts can reach R$ 2,080.91.Furthermore, after 15 days of the notification, the Ministry of Labor considers that the employer is aware, even if they have not accessed the DET mailbox.

How can an MEI register with DET?The registration of the MEI in DET is done entirely online. The initial deadline for registrations would end on May 1st, but it has been extended until August 1st.

Visit the DET website and click on “Enter the Gov”;Log in to Gov.br with your CPF and password; Now, click on “Add”;Enter your full name, phone number, and email; Finally, create a password, a kind of passphrase. After that, select “DET”, the environment has options such as “Mailbox”, “Authorizations”, and others.

And it will be through this that the government will contact the company. The current government is launching other novelties for the MEI, such as a loan program. Find out how it works by accessing this article written by me.Join the FDR community and receive free information on your Whatsapp!
