According to Anatel, the implementation of an active technological solution through excessive and massive phone calls lasting up to three seconds is considered an inappropriate practice even for telecommunications services.
Under the new measure issued by the agency, operators using robocalls have 15 days from the date of publication to take appropriate actions.The purpose is to adjust activities and cease the overload of robot-made phone calls to consumers without real human communication and a reasonable motive.
Once the deadline has expired, operators will be required to block calls from users who continue to generate abusive calls.
What will be the duration period for blocking telemarketing calls?The block on phone calls made by robots will last for 15 days or until the user formalizes a commitment with Anatel to refrain from inappropriate practices and present which measures they will take.
However, blocking originating calls should not affect the maintenance of other telecommunication services contracted by the user.
Operators must send a biweekly report to Anatel with information about users who have been blocked and the respective numbering resources used, as well as the volume of traffic and call blocking dates.
Anatel has determined through the precautionary measure that, within 30 days, telephony providers must block phone calls with numbers not assigned by the agency.
These are theoretically irregular telephone line numbers, regardless of whether they originate within the network or from other providers. Operators and users who do not comply with the new rules will be fined up to R$ 50 million.
